Chapter 18
Article II. Construction Industry and Technical Codes
DIVISION 1. GENERALLY
Sec. 18-36. Definitions.
- The following words, terms and phrases, when used in this article, shall
have the meanings ascribed to them in this section, except where the context
clearly indicates a different meaning:
Building means any structure built for support, shelter or enclosure
for any occupancy or storage including, but not limited to, a floating residential
unit.
Code inspector means any individual
authorized by the board through ordinance, resolution, policy or administrative
order, to enforce the provisions of this article, and who has the authority
to issue citations or notices to appear, including the building division director and authorized
representatives.
Codes or technical codes means the rules and regulations
pertaining to the trades adopted in this section by this article and all amendments
hereto, or any other adopted ordinance governing development in the county.
Compensation means the act or fact, expressed or implied, of
receiving a mutually agreed upon consideration in return for an action or service
rendered.
Contracting means, except as exempted in this part, engaging
in business as a contractor and includes, but is not limited to, performance
of any of the acts as set forth in F.S. §489.105(3), which defines some types
of contractors requiring licensure. The attempted sale of contracting services
and the negotiation or bid for a contract on these services also constitutes
contracting. If the services offered require licensure or agent qualification,
the offering, negotiation for a bid or attempted sale of these services requires
the corresponding licensure. However, the term "contracting" shall
not extend to an individual, partnership, corporation, trust, or other legal
entity that offers to sell or sells completed residences on property on which
the individual or business entity has any legal or equitable interest if the
services of a qualified contractor certified or registered pursuant to the requirements
of F/S/ch/489 have been or will be retained for the purpose of constructing
residences.
Contractor means any person who is qualified for and responsible
for an entire project contracted for and means the person for compensation,
undertakes to, submits a bid to, or does himself or by other, construct, alter,
repair, remodel, add to, subtract from or improve any building or structure,
including related improvements to real estate for others or for resale to others.
Engaged in business means doing any trade for any owner
or tenant of land or of a building, or any part thereof, or for any person in
possession or in charge of such land or building, or any part thereof, or entering
into a contract with any such owner, tenant, person, firm or corporation for
the doing of a trade.
Floating residential unit means a structure primarily
designed or constructed as a living unit built upon a floating base which is
not designed primarily as a vessel, is not self-propelled, although it may be
towed about form place to place, and is primarily intended to b anchored or
otherwise moored in a fixed location.
Limited specialty subcontractor means
a subcontractor whose scope of work and responsibility is strictly limited to
a specific subpart of a particular phase of construction. They may not use their
limited specialty subcontractor's license, or a combination of limited
specialty subcontractor's licenses in concert to act as contractor or specialty
contractor.
Specialty contractor means a contractor whose scope of work and
responsibility is limited to a particular phase of construction, or whose scope
of work is limited to a subset of the activities described in the categories
established in F.S. § 489.105(3)(a) (3)(p).
Start of construction or commenting construction means
the first placement of permanent construction of a structure on a site such
as the pouring of slabs or footers or any work beyond the stage of excavation,
including the relocation of a structure. The placement of a floating residential
unit in the waters of the county shall be deemed "start of construction"
and subject to all the codes adopted by this article and all amendments hereto.
Permanent construction does not include the installation of streets and/or walkways;
nor does it include the excavation for a basement, footings, piers or foundations,
or the erection of temporary forms. Start of construction for manufactured homes,
mobile homes, and premanufactured accessory structures, means the affixing of
the structure at a location other than the distributor's sales lot or site
of manufacture.
Subcontract means a secondary contract undertaking some or all
of the obligations and responsibilities of another contract.
Subcontractor means any person who engages in any business under
a subcontract, either express or implied.
Trade means, but is not limited to, construction, repair or removal
of a building or structures, plumbing, electrical, air conditioning, heating,
refrigeration, ventilation, roofing, swimming pool construction, setting and
placing mobile/manufactured homes and any other trades, without limitations,
requiring expert technical knowledge in the performance thereof.
The following terms and definitions shall have the same meaning as defined
in F.S. ch. 489, pt. 1 (F.S. § 489.101 et seq):
- General contractor;
- Building contractor;
- Residential contractor;
- Sheet metal contractor;
- Roofing contractor;
- Class A air conditioning contractor;
- Class B air conditioning contractor;
- Class C air conditioning contractor;
- Mechanical contractor;
- Commercial pool contractor;
- Residential pool contractor;
- Swimming pool servicing contractor;
- Plumbing contractor;
- Solar contractor;
- Underground utility and excavation contractor;
- Pollutant starage systems contractor; and
- Specialty contractor.
- As used in this article, the following specialty contractor classifications
shall have the following definitions unless a different meaning is clearly
intended and, unless otherwise noted, applicants therefor must pass a proctored
Block and Associates business and legal examination in addition to the required
Block and Associates proctored technical examination. Applications for a county
competency card tested under the sponsorship of another jurisdiction after
February 1, 1993, must show proof of successful completion of both examinations
prior to the issuance of such competency card:
Aluminum contractor means a
person engaged in the business of fabricating, installing, maintaining, repairing,
altering or extending accessories such as aluminum metal siding, and to construct
prefabricated aluminum rooms. Such contractors may not form, place reinforcing
steel and miscellaneous steel or pour, place and finish concrete, nor construct
wood framing for walls and decks incidental to the erection of aluminum accessory
structures.
Aluminum/concrete contractor means a person engaged in the business of fabricating, maintaining, repairing,
altering or extending accessories such as aluminum metal siding, and may construct
prefabricated aluminum rooms. These contractors may also form, place reinforcing
or other miscellaneous steel, and pour, place and finish concrete incidental
to the erection of such aluminum structures, and may construct wood frame walls
and decks incidental to the aluminum construction.
Carpentry contractor means
a person engaged in the business of installing any wood products in a building
or structure including but not limited to rough framing, structural and nonstructural,
installing trusses, sheathing, paneling, trim, etc. Nothing contained in this
section is intended to require those persons performing only paneling, cabinetry,
trim or other strictly cosmetic woodworking to obtain a county competency card.
Communication and sound contractor means those persons qualified to install, maintain, alter, repair or extend
wiring, apparatus, conduit, raceways, circuits or equipment operating at less
than 50 volts, used for private telephones, intercom or public address systems.
This contractor may connect to an existing circuit beyond the last overcurrent
device, but may not install burglar or fire alarm systems. This term shall not
include any employee of a telephone company regulated by the public service
commission. There shall be a business examination only. No technical examination
is required.
Concrete forming and placing
contractor means those persons qualified to batch and mix aggregate
cement and water to agreed specifications, to construct forms and frameworks
for the casting and shaping of concrete, to place miscellaneous embedded steel
and to pour, place and finish concrete.
Concrete place and finishing
contractor means those persons qualified to pour, place and finish
concrete flatwork (floors, slab on grade, sidewalks, etc.), including the placement
of wire mesh and steel reinforcement, vapor barriers and edge forms incidental
thereto.
Dock and seawall contractor means a person engaged in the business of constructing seawalls, bulkheads,
revetments, docks, piers, wharfs, groins and other marine structures, including
piledriving.
Drywall contractor means a person
engaged in the business of installing gypsum drywall products to wood and metal
studs, wood and steel joists and metal runners in buildings of unlimited area
and height. The scope of work shall include the preparation over which the drywall
product is to be applied, including he placement of metal studs and runners
and all necessary trim, as well as taping, finishing, application of spray finish,
etc.
Gunite/shotcrete contractor means
those who are qualified to use and maintain pressure equipment, mix cement based
materials and apply the same according to building codes.
Insulation contractor means a person
engaged in the business of installing, maintaining, repairing, altering or extending
any thermal insulation product primarily installed to prevent loss or gain of
heat from rooms or buildings.
Irrigation sprinkler contractor means a person who is qualified to install, maintain, alter, repair or extend
all piping, sprinkler heads and related equipment such as, but not limited to,
time clocks, low voltage wiring and water hookups to preexisting pumps, or central
water systems used for the irrigation of residential or commercial lawns and/or
landscaping with the exclusion of verifiable agricultural enterprises. Any electrical
work other than low voltage control wiring (less than 50 volts) must be performed
by a licensed electrical contractor.
Limited specialty subcontractors (no exam required) means the following:
- Pool steel limited specialty subcontractor means qualified to place steel reinforcement and edge forms incidental to
the construction of inground swimming pool shells.
- Marcite limited specialty subcontractor means qualified to mix and apply a type of cementitious compound containing
marble dust as an interior finish to swimming pool shells.
- Drywall installation limited specialty
subcontractor means qualified to install gypsum drywall to wood and
metal studs, wood and steel joists and metal runners. The scope of work shall
not include any preparation over which the product is to be applied.
- Drywall tape and finish limited
specialty subcontractor means qualified to tape and finish the gypsum
drywall product. Finishing is limited to the use of a joint compound material
and/or application of a spray finish.
Masonry contractor means a person who
is qualified to execute contracts requiring the skill, knowledge, ability and
experience to install, alter, repair, maintain and replace any assembly of preformed
masonry block, glass block, brick or other masonry products in conjunction with
the use o f a compatible binder or filler for the purpose of crating a structure
of any type, including the forming and pouring of the beams and lintels incidental
to the masonry construction, but shall not include the forming, pouring and
finishing of concrete flatwork.
Masonry/concrete contractor means
a person who is qualified to do the work of a masonry contractor, as well as
to pour place and finish concrete flatwork (floors, sidewalks, slabs on grade,
etc.) including installation of wire mesh, steel reinforcement, vapor barriers
and edge forms incidental thereto.
Mobile/manufactured home repair contractor means any person who is qualified to remodel, repair, improve or demolish
mobile homes only, except that such contractors must subcontract any electrical,
plumbing, mechanical or roofing repairs to a licensed contractor in the appropriate
trade unless such mobile home contractor also holds an active competency card
or state certification in the trade in which the repair is made, and whose certificate
of competency was issued and valid on April 7, 1993. The holders of such certificates
of competency shall be eligible for license renewal, subject to the requirements
contained herein, and shall continue to be regulated by the construction licensing
and appeals board.
Plastering/stucco contractor means
a person who is qualified to coat surfaces within a mixture of sand or other
aggregate and gypsum plaster, Portland cement, quicklime and water or any combination
of such materials as to create a permanent surface coating including, but not
limited to, plaster, stucco, etc. Such contractor may apply and affix gypsum
or lath or any other product prepared or manufactured, including the placement
of metal studs and runners to which lath is to be applied, to provide key or
suction bases for the support of the plaster coating.
Sign contractor (electrical) means
a person engaged in the business of installing , altering, repairing, adding
to, or changing any electrical wires, apparatus, raceways, conduit or any part
thereof on electrical signs and is qualified to erect signs. Such contractors
may connect to an existing sign circuit and may contract for and take out building
permits for the erection of signs.
Sign contractor (nonelectrical) means a person who is qualified to install, repair, alter and to or change
nonelectrical signs according to adopted building codes. Signs which are temporary/portable,
as defined in the county land development code, are exempt.
Structural steel contractor means
a person who is qualified to erect structural steel shapes and plates, including
such minor field fabrications as may be necessary, of any profile, perimeter
or cross section that are or may be used as structural members for buildings
and structures, including riveting, welding and rigging, only in connection
therewith.
Television and radio antenna contractor means a person who is qualified to erect or install any antenna, tower, or satellite
dish for transmitting or receiving television or radio wave signals, including
associated low-voltage wiring. The term shall not include any person who possesses
a federal license to construct antennas and/or towers. (No technical examination
is required. It is a business exam only.)
Tile and marble contractor means a person
who is qualified in the setting of tile or marble in any building, swimming
pool or other structure of any kind.
